Starting from August 1st, Shanghai's survey and design bidding will adopt credit based city divisions
On July 12th, the Shanghai Municipal Commission of Housing and Urban Rural Development disclosed that in order to further regulate the order of the city's construction market, establish and improve the integrity mechanism of construction engineering survey and design enterprises, and create a market environment of integrity and law-abiding, in accordance with relevant laws and regulations such as the "Tendering and Bidding Law of the People's Republic of China" and the "Implementation Regulations of the Tendering and Bidding Law of the People's Republic of China", the Municipal Commission of Housing and Urban Rural Development issued the "Notice on the Application of Credit Evaluation Results of Construction Engineering Survey and Design Enterprises in Shanghai in Construction Engineering Tendering and Bidding". The Notice proposes that survey, design, survey and design consolidation, engineering general contracting and other projects that will issue bidding notices from August 1, 2023 shall be executed in accordance with the Notice.
In response to the requirements of the Municipal Housing and Urban Rural Development Management Committee and to enable member units of the association's survey and design to better understand the content of the "Notice", on July 28th, the Shanghai Survey and Design Industry Association invited Shen Hong, Deputy Director of the Construction Market Supervision Department of the Shanghai Housing and Urban Rural Development Management Committee, to promote the document. Deputy Director Shen Hong emphasized the scope of application of the "Notice": for construction projects that must be tendered in Shanghai according to law, the tenderer shall apply the credit evaluation results of construction engineering survey and design enterprises in Shanghai during the bidding stage in accordance with the relevant provisions of the "Shanghai Construction Engineering Survey and Design Enterprise Credit Evaluation Management Measures (Trial)" and the "Shanghai Construction Engineering Survey and Design Enterprise Credit Evaluation Standards (Trial) (2021 Edition)".
The tenderer shall include relevant clauses for credit evaluation and review in the bidding documents during the engineering survey and design phase, and convert the credit evaluation results of survey and design enterprises in Shanghai into credit evaluation and review scores for application.
The credit evaluation results of construction engineering survey and design enterprises in Shanghai adopt a percentage system and are publicly available on official websites such as the Shanghai Municipal Commission of Housing and Urban Rural Development.
In terms of admission requirements, bidding projects that apply credit evaluation results should set credit qualification scores in the bidding documents. A credit score of 65 or higher for construction engineering survey and design enterprises in Shanghai is considered qualified. For bidding in the form of a consortium, the credit scores of all parties in the consortium should be greater than or equal to the qualified score. If the credit score is lower than the qualified score, the evaluation committee shall reject the bid. If the evaluation method adopts the comprehensive evaluation method, a credit evaluation score of 5 points should be set in the percentage based evaluation method. The credit score of bidders shall be calculated based on the credit score on the deadline for obtaining the bidding documents in the bidding announcement of the project.
（1） Survey and design bidding
In survey bidding and design bidding, if the bidder adopts the consortium method, the credit evaluation score shall be calculated based on the arithmetic mean of the credit scores of each party in the consortium.
（2） Design survey consolidation bidding
In the design and survey consolidation bidding, if the bidder adopts the consortium method, the credit evaluation score will be calculated comprehensively based on the weight of the design and survey scores in the bidding document evaluation method, and the design and survey credit scores corresponding to the division of labor of each member of the consortium.
（3） Engineering general contracting bidding
In the bidding of engineering general contracting, if the bidder adopts the consortium method, the credit evaluation score shall be calculated based on the arithmetic mean of the credit scores of the design, construction, and survey (if any) corresponding to the division of labor of each member of the consortium; If the bidder has multiple qualifications for independent bidding, the credit evaluation score will be calculated based on the arithmetic mean of their corresponding design, construction, and survey (if any) credit scores.
Bidders who adopt the consortium method in the above-mentioned (1), (2), and (3) bidding projects shall specify the relevant division of labor of the leader and other consortium members in the bidding documents in accordance with the requirements of the "Shanghai Construction Engineering Bidder Consortium Member Responsibility Division Table".
Deputy Director Shen Hong emphasized at the end of the promotion that the construction management departments and entrusted management units in Shanghai should strengthen supervision and guidance on the application of credit evaluation results by tenderers and bidders in bidding activities. For tenderers who exclude potential bidders by raising the credit score threshold, and bidders who illegally obtain credit scores through illegal means, relevant departments will hold them accountable in accordance with the law, creating an atmosphere of trustworthy incentives and dishonest punishment.
