Notice of the General Office of the Ministry of Emergency Management on conscientiously carrying out relevant work on diesel safety licensing

To the Emergency Management Departments (Bureaus) of all provinces, autonomous regions, and municipalities directly under the Central Government, the Emergency Management Bureau of the Xinjiang Production and Construction Corps, and relevant central enterprises:
Recently, the Ministry of Emergency Management and 10 other departments issued an announcement on the adjustment of the "Catalogue of Hazardous Chemicals (2015 Edition)", adjusting "1674 diesel [closed cup flash point ≤ 60℃]" to "1674 diesel". In accordance with the "Regulations on the Safety Management of Hazardous Chemicals", "Implementation Measures for Safety Production Permits for Hazardous Chemical Production Enterprises", "Measures for the Safety Supervision and Management of Hazardous Chemical Construction Projects", "Measures for the Management of Hazardous Chemical Business Permits" and other laws and regulations, the following notice is hereby issued on the work of diesel safety licensing:
1. Diesel refers to products that meet the national standards "Automotive Diesel" (GB 19147) and "B5 Diesel" (GB 25199), excluding BD100 biodiesel (monoalkyl esters of fatty acids obtained by reacting animal and plant oils or waste oils with alcohol). Enterprises that produce and operate diesel are managed as hazardous chemical enterprises.
2. For existing diesel production and operation enterprises, if all their production and storage facilities have been uniformly managed as hazardous chemicals and have obtained hazardous chemical production safety licenses or hazardous chemical business licenses in accordance with the law, they should go to the administrative licensing implementation authority before March 31, 2023 to update the "diesel [closed cup flash point ≤ 60℃]" in the license scope to "diesel".
3. For existing diesel production and operation enterprises (closed cup flash point > 60℃), if their production and storage facilities have not obtained the corresponding safety license, they should conduct safety status evaluation in accordance with the law; if they have not been formally designed, they should first conduct safety design diagnosis. After the enterprise meets the safety conditions and relevant regulations, it should apply for a hazardous chemical production safety license or a hazardous chemical business license in accordance with the law before June 30, 2023.
4. All new, rebuilt, and expanded construction projects for the production and storage of diesel should be strictly implemented in accordance with the relevant requirements of the "Regulations on Safety Supervision and Management of Hazardous Chemical Construction Projects".
5. Enterprises do not need to obtain safety production licenses for their own diesel refueling devices (not for external operation).
All provincial emergency management departments are requested to promptly convey the requirements of this notice to municipal and county emergency management departments and relevant enterprises, and organize relevant work.
